I understand and agree that, if I am employed by The Waterworks, my employment and/or compensation is entirely “at will,” which means neither are guaranteed for any definite period of time, and that my employment and/or compensation can be modified or terminated with or without cause, regardless of the date of payment of my wages and salary, and with or without prior notice at any time, at the option of either The Waterworks or myself.
I understand and agree that The Waterworks reserves the right to establish and change any of the terms and conditions of my employment, at its discretion, at anytime, as it deems appropriate.
I understand and agree that if any pervious agreements between any representative of The Waterworks and myself have been made, they are superseded by the contents of this Agreement.
I understand and agree that no representative of The Waterworks, other than the President, the Chairman of the Board, or the Board of Directors as a whole, have any authority to enter into any agreement with me relating to my employment with The Waterworks, or for the duration of my employment for any indefinite or specified period of time or to make any agreement with me contrary to the foregoing, except that the above-mentioned officials of The Waterworks may do so in writing.
I also certify that the facts contained in this application are true and complete to the best of my knowledge and understand that if I am employed, any statements I have falsified on this application shall be grounds for dismissal. I further certify that I have read all of the foregoing, understand the same and do hereby voluntarily agree to all of the provisions contained herein.
I understand that, in the Company’s discretion, any offer of employment may be conditioned on the results of a criminal background check, a credit review, a physical or medical examination and a drug test.
In considering and evaluating your employment application, including whether to offer you employment, as well as in making decisions concerning employment if you are hired, The Waterworks may obtain and use a “consumer report” from a “consumer reporting agency” about you. Under the Fair Credit Reporting Act, as an applicant or an employee, you are a “consumer.”
A “consumer report” is any written, oral or other communication of any information by a “consumer reporting agency” bearing on a consumer’s credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics or mode of living which is used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing the consumer’s eligibility for employment purposes.
A “consumer reporting agency” is a person or entity which, for monetary fees, dues, or on a cooperative nonprofit basis, regularly assembles or evaluates consumer credit information or other information on consumers for the purpose of furnishing “consumer reports” to others, such as The Waterworks.
If The Waterworks obtains a “consumer report” about you, and if The Waterworks considers information in the “consumer report” in making an employment-related decision that adversely affects you, before the decision is made final, you will be provided with a copy of the “consumer report” and a written description of your rights under the Fair Credit Reporting Act.
In conjunction with your application for employment, The Waterworks at its discretion also may obtain and use an “investigative consumer report” including information as to your character, general reputation, personal characteristics, and mode of living. An investigative consumer report involves personal interviews with sources such as neighbors, friends and associates. If an investigative consumer report is conducted with respect to your application, you have the right to request complete and accurate disclosure of the nature and scope of the investigation and a written summary of your rights under the Fair Credit Reporting Act.
In consideration of completing my application for employment at The Waterworks, I hereby knowingly and voluntarily authorize, request and direct The Waterworks to obtain “consumer reports” about me from “consumer reporting agencies” and to consider the “consumer reports” when making employment-related decisions about me. I also hereby knowingly and voluntarily authorize, request and direct any (i) governmental or law enforcement agency, (ii) consumer reporting agency, (iii) current or former employer(s), manager(s), and/or supervisor(s) and/or (iv) personal references identified by me to provide to The Waterworks and/or its designated agent(s) and/or representative(s) information concerning or relating to me. In consideration of my application, I hereby authorize The Waterworks to solicit and receive any such information. I hereby waive and release all rights to assert against The Waterworks and all other persons and entities claims of any nature whatsoever arising out of communications they make in reliance upon this paragraph, and I indemnify and hold harmless any person or entity from any liability incurred because of reliance upon this paragraph. I further waive and release all rights to assert against The Waterworks and all other persons and entities claims of any nature whatsoever arising out of decisions made relating to my employment or prospective employment based in whole or in part upon information obtained in accordance with this authorization. I understand that I have certain rights under the Fair Credit Reporting Act, including those rights discussed in the above Disclosure.
NOTE: Federal Law requires that an applicant be notified if employment is denied based on the contents of a credit report.
